1. Definitions

“Cartisto”, “we” or “us” means the provider of the Services. “You” or “Merchant” means the person or entity using the Services. “Customer” means an end user who shops at a Merchant’s store.

2. Eligibility and accounts

You must be at least 18 and able to enter a binding contract. You are responsible for the accuracy of your account information and for keeping your credentials secure.

You are responsible for all activity under your account and for any team members you invite.

3. The Services

Cartisto provides tools to create and operate online stores, including payments, shipping, point-of-sale, marketing and analytics. We may add, change or remove features, and we aim to give reasonable notice of material changes.

4. Acceptable use

You may not use the Services to break the law, infringe others’ rights, sell prohibited or counterfeit goods, transmit malware, attempt to breach security or tenant isolation, or overload or disrupt the platform.

We may suspend or limit access to protect the Services or other users.

5. Merchant content and responsibilities

You own the content and data you upload, and you grant us the licence needed to host and display it to operate the Services.

You are solely responsible for your products, prices, tax handling, customer communications, and compliance with the laws that apply to your store.

6. Subscriptions, billing and renewals

Paid plans are billed in advance on a recurring basis and renew automatically until cancelled. Fees are stated at checkout and may exclude taxes.

You authorise us to charge your payment method for each renewal. We may change pricing with notice; changes apply to the next billing cycle.

7. Cancellations and refunds

You may cancel at any time; cancellation takes effect at the end of the current billing period, and you keep access until then.

Except where required by law or expressly stated, fees already paid are non-refundable.

8. Intellectual property

The Services, including the platform software, look and feel, and Cartisto trademarks, are owned by us or our licensors and are protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Services; they do not transfer ownership.

9. Third-party services

The Services integrate with third parties such as payment gateways and shipping carriers. Your use of those services is governed by their own terms, and we are not responsible for them.

10. Disclaimers

The Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, Cartisto is not liable for indirect, incidental, special or consequential damages, or lost profits or data. Our total liability for any claim is limited to the amount you paid us for the Services in the twelve months before the claim.

12. Indemnification

You agree to indemnify and hold Cartisto harmless from claims arising out of your content, your store, or your breach of these Terms or of applicable law.

13. Suspension and termination

We may suspend or terminate access if you breach these Terms or create risk for the Services or other users. You may stop using the Services at any time. On termination, the rights granted to you end, and provisions that by their nature should survive will remain in effect.

14. Governing law and disputes

These Terms are governed by the laws of [Jurisdiction], without regard to conflict-of-law rules, and the courts of [Jurisdiction] have exclusive jurisdiction, unless mandatory local law provides otherwise.

15. Changes to these Terms

We may update these Terms from time to time. Material changes will be posted here with a new effective date; continued use after changes means you accept them.
